MILITARY CLAUSE ADDENDUM
If the TENANT is a member of the United States Armed Forces on active duty and during the term of this lease:
1. Is transferred Permanent Change of Station (PCS) Orders to a new location which is beyond a thirty mile radius from the current assignment, or
2. Is transferred under Temporary duty (TDY) or Temporary Additional duty (TAD) orders of an indefinite length which extend for more than 30 days to a location which is beyond a thirty mile radius from the current assignment, or
3. Is assigned to government quarters, or
4. Is declared by competent military authority as Missing in Action (MIA) or taken Prisoner of War (POW), or
5. Is voluntarily or involuntarily separated from active duty in the Armed Forces or retires and will be moving under government orders to a location beyond a thirty mile radius from the current assignment, or
6. The TENANT or spouse should die.
Then the TENANT or spouse may terminate this lease without forfeiting any security deposit or being liable for the remaining term of lease by giving at least thirty (30) days written notice, with record of delivery to the LANDLORD.
The notice must state the basis for the release and state the date of termination, which in any case may not be less than thirty (30) days from the date of receipt or delivery of notice to the LANDLORD. The TENANT will provide copies of any official government orders if available or other correspondence from competent United States government authorities documenting the basis for the TENANT's claimed release. The LANDLORD may approve the release upon receipt of the notice or make the release contingent upon receipt of the documentation.
